Workplace disputes can be detrimental to both employees and employers, affecting morale, productivity, and the overall work environment. Mediation offers a proactive and transformative approach to address these conflicts, creating a platform for open and honest communication and, ultimately, fostering resolution. In the context of workplace disputes, mediation serves as a confidential and impartial process in which employees can voice their concerns, while employers can listen and address those issues constructively. A trained mediator guides these conversations, helping parties find common ground, identify underlying concerns, and collaboratively develop practical solutions. Mediation empowers employees to have a say in the resolution of their disputes and promotes a harmonious work atmosphere, improving job satisfaction and reducing the potential for costly litigation. By choosing mediation, organizations invest in a healthier, more productive, and more collaborative workplace culture.
Workplace disputes usually centre around:
Interpersonal Conflicts
Harassment or Discrimination
Team or Departmental Conflicts
Communication Breakdown
Performance Issues
Contractual Disputes
Workplace Change
Employee-Employer Disagreements
Workplace Bullying
Mediation in Termination or Severance
Initial Contact: Meditation is usually requested the employer where an overview of the situation is given and I outline how I work with workplace dispute resolution.
Pre-Mediation Intro Meeting with the Parties: I meet initially with each party separately or together on zoom or in person. The purpose of this session is to introduce ourselves and outline how we will work together. I will draft up the meditation agreement and terms of operation.
Agreement Exploratory Session: Next we have an agreement exploratory session during which each party has the opportunity to say their individual needs and wishes. As a mediator, I will seek to understand and explore the situation from different viewpoints. We explore the possibilities with the goal of helping the parties to reach a settlement agreement of how to move forward. If the parties so wish, I will write the agreement terms formally to support their ongoing relationship.
Whilst mediation is usually arranged by an employer, the proceedings and agreement between the parties is completely confidential
My process of interacting with the employer and the parties is completely separate. No report will be issued to the employer without the parties consent.
Location: Sessions can take place on Zoom or in person in Foxrock, Dublin.
Duration: The process will take approximately 2 sessions with 2 weeks between each session. Ideally the process can be completed within 1 month.
